الشروط والأحكام (شروط الخدمة)

تحكم هذه الشروط استخدامك لمنصّة سهل على app.trysahel.com («المنصّة» أو «الخدمة»)، المُشغَّلة من قِبل شركة الديار للتنمية والاستثمار (السجل التجاري رقم 1540010)، سلطنة عُمان («سهل»، «نحن»). بإنشائك حساباً أو استخدامك المنصّة فإنك توافق على هذه الشروط.
1. الأهلية
يجب أن تكون شخصاً لا يقل عمره عن 18 عاماً، وتمتلك صلاحية إلزام نشاطك التجاري بهذه الشروط. الخدمة موجّهة للأنشطة التجارية والمهنية داخل سلطنة عُمان.
2. الخدمة
سهل منصّة برمجية سحابية (SaaS) تساعد الأنشطة على التحوّل من الورق إلى أدوات رقمية (مثل إنشاء الفواتير وإدارة الشيكات ونظام حجز الملاعب)، عبر اشتراكات شهرية مستقلة لكل أداة. تُقدَّم الخدمة «كما هي»، وقد نضيف أو نعدّل أو نوقف أدوات مع إشعارك بذلك.
3. الحساب والأمان
أنت مسؤول عن سرّية بيانات دخولك وعن كل نشاط يجري عبر حسابك. نتحقق من بريدك الإلكتروني برمز لمرة واحدة عند التسجيل. أبلغنا فوراً عند أي استخدام غير مصرّح به.
4. الاشتراكات والأسعار والدفع
الأسعار بالريال العماني (OMR) وتُدفع شهرياً ومقدّماً عبر بوابة الدفع Paymob. تبدأ الخدمة فور نجاح الدفع. لا نخزّن أرقام البطاقات على خوادمنا مطلقاً؛ تتولّى Paymob ذلك وفق معيار PCI-DSS.
5. التجديد التلقائي (مهم)
اشتراكك يتجدد تلقائياً كل شهر بنفس القيمة عبر بطاقتك المحفوظة لدى Paymob، إلى أن تقوم بإلغائه. بإتمامك الدفع الأول فإنك تفوّض سهل بخصم رسوم الاشتراك الشهرية تلقائياً من بطاقتك حتى الإلغاء. يمكنك الإلغاء في أي وقت من لوحة التحكم، ويسري الإلغاء على الدورات القادمة.
6. الفترة التجريبية المجانية
قد نتيح فترة تجريبية مجانية (7 أيام) لبعض الخدمات، لمرة واحدة لكل خدمة ولكل حساب. لبدء التجربة يجب إدخال بطاقة صالحة، ونقوم بخصم مبلغ رمزي بسيط للتحقق من البطاقة فقط.
مهم: عند انتهاء الفترة التجريبية يُخصم الاشتراك كاملاً تلقائياً من البطاقة نفسها، ويستمر التجديد التلقائي بعدها وفق البند (5)، ما لم تقم بإلغاء الاشتراك قبل انتهاء الفترة التجريبية. يمكنك الإلغاء في أي وقت خلال الفترة التجريبية من لوحة التحكم، وفي هذه الحالة لا يُخصم مبلغ الاشتراك. نعرض لك تاريخ انتهاء التجربة داخل لوحة التحكم طوال مدتها.
7. الضرائب
الأسعار المعروضة قد لا تشمل ضريبة القيمة المضافة (5%) ما لم يُذكر خلاف ذلك. إن كنّا مسجّلين لأغراض الضريبة فسنضيفها ونُصدر فاتورة ضريبية نظامية.
8. الإلغاء والاسترجاع
يمكنك إلغاء أي اشتراك في أي وقت؛ تبقى الخدمة فعّالة حتى نهاية الفترة المدفوعة ثم لا تتجدد. تفاصيل الاسترجاع في سياسة الإلغاء والاسترجاع.
9. التعليق والإنهاء
عند فشل التجديد يصبح الاشتراك «متأخر السداد» وقد يُعلَّق بعد فترة سماح مدتها 14 يوماً. يحق لنا تعليق أو إنهاء الحسابات المخالفة لهذه الشروط أو للقانون.
10. الاستخدام المقبول
يُمنع استخدام المنصّة لأي غرض غير قانوني، أو للاحتيال، أو لانتهاك حقوق الغير، أو لمحاولة اختراق أو تعطيل الخدمة، أو إدخال بيانات مضلّلة. المخالفة قد تؤدي للتعليق الفوري.
11. بياناتك ومسؤوليتك عنها
بيانات عملك التي تُدخلها ملك لك. عند إدخالك بيانات شخصية لأطراف ثالثة (مثل أسماء وأرقام عملائك في الحجوزات) فأنت «المتحكّم» بها وتقرّ بأنك جمعتها بشكل قانوني وبموافقة أصحابها، ونحن نعالجها «كمعالِج» نيابةً عنك لتقديم الخدمة فقط. تفاصيل في سياسة الخصوصية.
12. الملكية الفكرية
المنصّة وبرمجياتها وتصاميمها وعلاماتها ملك لسهل. تحتفظ أنت بملكية بياناتك. لا يجوز نسخ أو إعادة هندسة المنصّة.
13. مزوّدو الخدمة الخارجيون
نعتمد على مزوّدين موثوقين: Cloudflare (الاستضافة)، Paymob (الدفع)، Resend (البريد). استخدامك للخدمة يخضع أيضاً لممارساتهم.
14. إخلاء المسؤولية وحدودها
تُقدَّم الخدمة «كما هي» دون ضمانات تتجاوز ما يفرضه القانون. لا نتحمّل مسؤولية الأضرار غير المباشرة أو التبعية، وتقتصر مسؤوليتنا الإجمالية—بالقدر الذي يسمح به قانون عُمان—على قيمة ما دفعته خلال الأشهر الثلاثة السابقة للمطالبة.
15. التعويض
توافق على تعويض سهل عن أي مطالبات ناشئة عن مخالفتك لهذه الشروط أو عن بياناتك أو استخدامك للخدمة.
16. تعديل الشروط والأسعار
قد نُحدّث هذه الشروط أو الأسعار مع إشعارك عبر البريد أو داخل المنصّة قبل السريان بوقت معقول. استمرارك في الاستخدام يعني قبولك.
17. القانون الحاكم
تخضع هذه الشروط لقوانين سلطنة عُمان، وتختص محاكم مسقط بأي نزاع.

Terms of Service

These Terms govern your use of the Sahel platform at app.trysahel.com (the "Platform" or "Service"), operated by AL DIYAR DEVELOPMENT INVESTMENT (Commercial Registration No. 1540010), Sultanate of Oman ("Sahel", "we", "us"). By creating an account or using the Platform you agree to these Terms.
1. Eligibility
You must be at least 18 years old and authorized to bind your business to these Terms. The Service is intended for commercial and professional use within the Sultanate of Oman.
2. The Service
Sahel is a cloud software (SaaS) platform that helps businesses move from paper to digital tools (such as invoice generation, cheque management, and a court-booking system), offered as independent monthly subscriptions per tool. The Service is provided "as is", and we may add, change, or discontinue tools with notice.
3. Account & security
You are responsible for keeping your credentials confidential and for all activity under your account. We verify your email with a one-time code at signup. Notify us immediately of any unauthorized use.
4. Subscriptions, pricing & payment
Prices are in Omani Rial (OMR), billed monthly in advance through the Paymob payment gateway. Service begins upon a successful payment. We never store card numbers on our servers — Paymob handles them under PCI-DSS.
5. Automatic renewal (important)
Your subscription renews automatically every month for the same amount using your card stored securely with Paymob, until you cancel. By completing your first payment you authorize Sahel to charge the monthly fee to your card automatically until cancellation. You may cancel anytime from your dashboard; cancellation applies to future cycles.
6. Free trial
We may offer a 7-day free trial on some services, once per service per account. Starting a trial requires a valid card, and we take only a small card-verification charge at that point.
Important: when the trial ends, the full subscription price is charged automatically to the same card, and auto-renewal then continues under clause (5) — unless you cancel before the trial ends. You can cancel at any time during the trial from your dashboard, in which case no subscription charge is taken. Your trial end date is shown in your dashboard throughout.
7. Taxes
Displayed prices may exclude VAT (5%) unless stated otherwise. Where we are tax-registered, VAT is added and a compliant tax invoice is issued.
8. Cancellation & refunds
You may cancel any subscription at any time; the service remains active until the end of the paid period, then does not renew. See the Refund & Cancellation Policy.
9. Suspension & termination
If a renewal fails, the subscription becomes "past due" and may be suspended after a 14-day grace period. We may suspend or terminate accounts that breach these Terms or the law.
10. Acceptable use
You may not use the Platform for any unlawful purpose, fraud, infringing others' rights, attempting to breach or disrupt the Service, or entering misleading data. Violations may lead to immediate suspension.
11. Your data & your responsibility
The business data you enter belongs to you. When you enter third parties' personal data (e.g. your booking customers' names and phone numbers), you are the "controller" and confirm you collected it lawfully and with consent; we act only as a "processor" on your behalf to deliver the Service. 12. Intellectual property
The Platform, its software, designs, and marks belong to Sahel. You retain ownership of your data. You may not copy or reverse-engineer the Platform.
13. Third-party providers
We rely on trusted providers: Cloudflare (hosting), Paymob (payments), Resend (email). Your use is also subject to their practices.
14. Disclaimers & limitation of liability
The Service is provided "as is" without warranties beyond those required by law. We are not liable for indirect or consequential damages, and our total liability — to the extent permitted by Omani law — is limited to the amount you paid in the three months preceding the claim.
15. Indemnity
You agree to indemnify Sahel against claims arising from your breach of these Terms, your data, or your use of the Service.
16. Changes to terms & pricing
We may update these Terms or prices with reasonable prior notice by email or in-app. Continued use means acceptance.
17. Governing law
These Terms are governed by the laws of the Sultanate of Oman; the courts of Muscat have jurisdiction over any dispute.
